Although policyholders are entitled to file insurance claims independently, data from experts in the industry suggest this strategy may not provide ideal results.

The main challenges with self-filing include:

  • Complex documentation requirements and policy interpretation
  • Time-intensive communication with insurance representatives
  • Risk of overlooking covered damages or benefits
  • Potential undervaluation of claims by insurance companies
  • Limited-to-zero negotiation experience with insurers

Licensed public adjusters have significant advantages in the claim process:

  •
    1. Professional Documentation and Assessment – Public adjusters thoroughly document damages, prepare comprehensive claim files, and handle all necessary paperwork, making sure no detail is left unnoticed.
    2. Time and Stress Management – These professionals handle all communications with insurance companies, allowing homeowners to focus on recovering while speeding up the claims process.
    3. Expert Negotiation – With extensive knowledge of insurance policies and regulations, public adjusters negotiate directly with insurance companies to negotiate fair settlements.
    4. Cost-Effective Service – Public adjusters typically work on a contingency fee basis, which typically ranges from 10 to 20 percent of the settlement amount, to ensure the best interests of the policyholder.

The National Association of State Insurance Commissioners (NAIC) recognizes public adjusters as licensed professionals who represent policyholders’ interests during the claims process. Their expertise is particularly useful in complicated claims or when significant damages are involved.

Although contractors frequently offer the opportunity to negotiate with insurers, this method can come with significant limitations and potential risks. According to the National Association of Insurance Commissioners (NAIC), contractors lack the legal authority and expertise to be representative for insurers in claim negotiations.

This limitation can significantly impact the outcomes of a lawsuit and may limit any rights granted to the owner of the policy.

Departments of insurance in each state regulate licensed public adjusters, who undergo extremely specialized training, undergo Federal background checks, & require specialized licenses from the state before they can operate. They also have the legal authority to represent the policyholder in order to protect and protect their right … legal authority that contractors don’t possess … thus they are the legal and comprehensive alternative to contractor representation.

Public Adjusters are experts in interpreting insurance policies, documenting damages, and working with insurance companies in order to secure equitable settlements.

Public adjusters provide several distinct advantages, which include:

  • Expert claim documents and filing
  • Professional negotiation with insurance companies
  • Comprehensive damage assessment
  • Accelerated claim processing
  • Reduce stress by a complete claim management

The National Association of Public Insurance Adjusters (NAPIA) insists on the fact that public claims adjusters must hold professional licenses and follow strict ethical standards, thereby providing another layer of consumer protection that is not offered by the representation of contractors.

For complex claims, for more complex claims, public adjusters’ expertise in the interpretation of policies, documentation demands and negotiation strategies frequently is invaluable, and can help avoid costly mistakes and claims denials that might occur with the use of contractors in negotiations.

If insurance settlements are not sufficient to pay for property damage, policyholders retain several legal options for seeking further compensation after the initial settlement of their claim.

As per the National Association of Insurance Commissioners (NAIC), NAIC recommends that policyholders be sure to carefully review their settlement terms and related documentation before accepting the final settlement.

The timing and the circumstances for seeking additional compensation are crucial aspects, as the majority of insurance policies include specific deadlines for claims disputes and appeals, generally ranging from one to two years following the settlement date.

Licensed public claims adjusters are essential in re-evaluating settlement claims and in identifying previously unnoticed damages. Public adjusters perform thorough assessments of property damages, as well as document any additional damage, and deal with insurance companies in the interest of policyholders.

The most important steps to pursue additional compensation include:

  1.  Document newly discovered damages
  2. Review of policy terms and settlement agreements
  3. Collect new evidence and estimates
  4. Consider professional representation from a state-licensed public insurance claims adjusters

The National Association of Public Insurance Adjusters (NAPIA) insists that public adjusters are often able to identify missed damages and policy provisions that support an additional amount of compensation. Their experience in policy interpretation and claim valuation is particularly useful when challenging settled claims.

Policyholders should take action immediately after discovering inadequate settlement amounts, since delay can compromise their ability to collect additional compensation. When utilizing a public adjuster’s services, the claim review and negotiation process typically progresses more efficiently than policyholder-directed efforts.

The importance of public adjusters also goes beyond financial benefits. These professionals provide professional guidance throughout the claims process, explaining the complexities of policy and ensuring that all damage is properly documented and assessed.

They prepare detailed damage estimates, gather necessary evidence, and deal directly with insurance carriers in order to get the best settlement results.

No. Insurance companies cannot legally cancel policies solely because policyholders hire public adjusters to represent their interests during the claims process, according to the National Association of Insurance Commissioners (NAIC). Policy cancellations are strictly governed by contractual terms and state regulations, typically limited to specific circumstances such as non-payment of premiums or material misrepresentation.

The National Association of Public Insurance Adjusters (NAPIA) emphasizes that hiring a licensed public claims adjusters is a protected right of policyholders. These professionals serve as advocates during insurance claims, handling documentation, negotiations, and communications with insurance carriers to expedite settlements.
