- Potential undervaluation of claims by insurance companies

In Niles Junction, Can My Contractor Represent Me Against My Insurance Company?
While many contractors offer the opportunity to negotiate with insurers, this method can come with serious risks and restrictions. According to the National Association of Insurance Commissioners (NAIC), contractors are not legally authorized and lack know-how to act as official representatives in insurance claim negotiations.
This restriction could dramatically affect the outcome of a case and potentially affect any rights granted to the insurance company.
Departments of insurance in each state oversee licensed public adjusters, who undergo intensive specialized training, must pass Federal background checks, & require specialized licensing by the state to operate. They also have the legal authority to represent the policyholder in order to protect and defend their rights … legal authority that contractors do not possess … thus they are the legal alternative to the representation of contractors.

Public adjusters provide several distinct advantages, including:
- Professional claim documents and filing
- Professional negotiation with insurance companies
- Comprehensive damage assessment

- Stress reduction by a complete claim management
The National Association of Public Insurance Adjusters (NAPIA) emphasizes the fact that public adjusters must maintain professional licenses and follow strict ethical standards, thereby providing the additional level of consumer protection not available with contractors.
For complex claims, public adjusters have a wealth of knowledge in interpreting policies, document specifications and negotiation techniques often can be invaluable, thereby avoiding costly mistakes and claims denials which could result from contractor-led negotiations.

I Already Settled My Claim, But It Wasn’t Enough To Cover The Damages. Is It Too Late To Try To Get More?
When insurance settlements prove insufficient to pay for property damage, the policyholder has a variety of legal options for seeking additional compensation, even following the initial claim settlement.
According to the National Association of Insurance Commissioners (NAIC), NAIC recommends that policyholders be sure to carefully review the terms of their settlement and related documentation before accepting the final settlement.
The timing and the circumstances for seeking additional compensation are crucial elements, as most insurance policies have specific deadlines for claims disputes or appeals, usually between one and two years after settlement date.
Licensed public claims adjusters are crucial in re-evaluating settled claims and identifying overlooked damages. Public adjusters perform thorough property assessments, as well as document any additional damage, and deal with insurance companies on behalf of policyholders.
Important steps to pursue additional compensation are:
- Document newly discovered damages
- Review the policy terms and settlement agreements
- Gather new evidence and estimations
- Request professional representation from a state-licensed public insurance adjusters
The National Association of Public Insurance Adjusters (NAPIA) emphasizes that public adjusters are often able to spot overlooked damages and policy provisions that allow for an additional amount of compensation. Their knowledge of the interpretation of policies and claim valuation proves particularly valuable when defending settled claims.
The policyholder should respond quickly after discovering inadequate settlement amounts, as delay can compromise their ability to collect additional compensation. When utilizing a public adjuster’s services, the claim review and negotiation process typically progresses more efficiently than policyholder-directed efforts.
