While policyholders have the right to file insurance claims on their own, research from industry experts suggests this method may not produce the best results.

The main challenges with self-filing include:

  • Complex documentation requirements and policy interpretation
  • Time-intensive communication with insurance representatives
  • Risk of overlooking covered damages or benefits
  • Potential undervaluation of claims by insurance companies
  • Limited-to-zero negotiation experience with insurers

licensed public adjusters provide substantial advantages during the claim process:

  •
    1. Professional Documentation and Assessment – Public adjusters thoroughly document damages, prepare comprehensive claims files, and manage all necessary paperwork, ensuring no detail is left unnoticed.
    2. Time and Stress Management – These professionals handle all communications with insurance companies, allowing homeowners to focus on recovery while expediting the process of filing claims.

This limitation can dramatically affect the outcomes of a case and potentially compromise the rights of the insurance company.

The state insurance departments regulate licensed public adjusters, who receive highly specialized training, undergo Federal background checks, & require special licensing from the state in order to work. They also have the legal authority to act on behalf of the policyholder to safeguard and defend their rights … legal authority that contractors do not possess … making them the legal alternative to representation by contractors.

When insurance settlements fail to cover property damages, policyholders have a range of legal options to seek further compensation following the initial claim settlement.

According to the National Association of Insurance Commissioners (NAIC), policyholders should be sure to carefully review the terms of their settlement and related documentation before accepting the final settlement payment.

The timing and the circumstances for the pursuit of additional compensation are important elements, as most insurance policies have specific timeframes for dispute resolution and appeals, typically ranging from one to two years after settlement date.

Licensed public claims adjusters are vital in re-assessing settled claims and identifying previously unnoticed damages. Public adjusters carry out thorough property assessments, document any additional damages, and negotiate with insurance carriers for policyholders.

Important steps to pursue additional compensation include:

  1.  Document newly discovered damages
  2. Review policy terms and settlement agreements
  3. Collect supporting evidence and estimations
  4. Consider professional representation from a state-licensed public insurance claims adjusters

The National Association of Public Insurance Adjusters (NAPIA) stresses that public adjusters are often able to identify missed damages and policy provisions which allow for an additional amount of compensation. Their experience in policy interpretation and claim valuation is especially valuable when defending settled claims.

Policyholders should take action immediately when they discover insufficient settlement amounts, since delay could hinder their ability to collect additional compensation. When utilizing a public adjuster’s services, the claim review and negotiation process typically progresses more efficiently than policyholder-directed efforts.

No. Insurance companies cannot legally cancel policies solely because policyholders hire public adjusters to represent their interests during the claims process, according to the National Association of Insurance Commissioners (NAIC). Policy cancellations are strictly governed by contractual terms and state regulations, typically limited to specific circumstances such as non-payment of premiums or material misrepresentation.
